These Terms of Use ("Terms") govern your use of the Kelpulator mobile application and related services (collectively, the "Service") provided by Kelpulator ("we", "us", or "our"). By using the Service, you agree to these Terms.
1. Acceptance of Terms
By creating an account or using the Service, you agree to be bound by these Terms and our Privacy Policy. If you do not agree, do not use the Service.
2. Description of Service
Kelpulator is a mobile application that helps offshore anglers predict kelp paddy drift using GPS data, wind forecasts, ocean current data, and tidal models. The Service also allows users to form crews (groups) to share fishing marks and field reports.
3. Account Registration
You must create an account to use the Service. You are responsible for maintaining the security of your account credentials and for all activity that occurs under your account. You must provide accurate information when creating your account.
4. User Responsibilities
You agree to:
- Use the Service in compliance with all applicable laws and regulations
- Ensure that any content you share (marks, reports, photos, voice memos) does not violate the rights of others
- Not use the Service for any unlawful purpose
- Not attempt to interfere with, compromise, or disrupt the Service
- Not create multiple accounts for abusive purposes
5. Acceptable Use
You may not use the Service to:
- Harass, threaten, or intimidate other users
- Share content that is defamatory, obscene, or otherwise objectionable
- Impersonate any person or entity
- Collect or harvest information about other users without their consent
- Transmit malware, viruses, or any other malicious code
- Circumvent any access controls or usage limits
6. User Content
You retain ownership of content you create in the Service (marks, reports, photos, voice memos). By sharing content with a crew, you grant other crew members the ability to view that content within the Service. We do not claim ownership of your content.
We reserve the right to remove content that violates these Terms or that we reasonably believe is harmful to other users or the Service.
7. Intellectual Property
The Service, including its design, code, graphics, and branding, is owned by Kelpulator and protected by applicable intellectual property laws. You may not copy, modify, distribute, or reverse-engineer any part of the Service without our written permission.
8. Important Disclaimers
Not a Safety Device
Kelpulator is a fishing tool, not a navigation or safety device. Do not rely on the Service for marine navigation, safety decisions, or emergency situations. Always follow proper maritime safety practices and carry appropriate safety equipment.
No Fishing Guarantees
Drift predictions and ocean data are estimates based on forecast models and observational data. We make no guarantees about the accuracy of predictions or that you will find fish or kelp at predicted locations. Fishing success depends on many factors beyond the scope of this Service.
Weather and Ocean Data
Weather, wind, current, tide, and other environmental data provided by the Service is sourced from third-party providers (including NOAA) and is provided "as is." We do not guarantee the accuracy, completeness, or timeliness of this data. Always check official marine weather forecasts before heading offshore.
9. Limitation of Liability
TO THE MAXIMUM EXTENT PERMITTED BY LAW, KELPULATOR AND ITS OFFICERS, DIRECTORS, EMPLOYEES, AND AGENTS SHALL NOT BE LIABLE FOR ANY INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, OR PUNITIVE DAMAGES ARISING FROM YOUR USE OF THE SERVICE, INCLUDING BUT NOT LIMITED TO LOSS OF DATA, LOSS OF PROFITS, PERSONAL INJURY, OR PROPERTY DAMAGE.
THE SERVICE IS PROVIDED "AS IS" AND "AS AVAILABLE" WITHOUT WARRANTIES OF ANY KIND, EITHER EXPRESS OR IMPLIED, INCLUDING BUT NOT LIMITED TO IMPLIED WARRANTIES OF MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, AND NON-INFRINGEMENT.
10. Indemnification
You agree to indemnify and hold harmless Kelpulator from any claims, damages, losses, or expenses (including reasonable attorney's fees) arising from your use of the Service or violation of these Terms.
11. Termination
We may suspend or terminate your access to the Service at any time for violation of these Terms or for any other reason at our discretion. You may delete your account at any time by contacting us at support@kelpulator.com.
12. Changes to These Terms
We may update these Terms from time to time. We will notify you of material changes by posting the updated Terms in the App or on our website. Continued use of the Service after changes constitutes acceptance of the revised Terms.
13. Governing Law
These Terms are governed by the laws of the State of California, United States, without regard to its conflict of law provisions.
